Judge says Dannenbaum evading service of lawsuit
Comments 0 | Recommend 0State District Judge Ben Euresti found Friday that Dannenbaum Engineering Corp. evaded service of the lawsuit that Brownsville Navigation District board Commissioner Peter Zavaletta, as a taxpayer, filed against the Houston-based firm.
Euresti, who presides over the 107th state District Court, instead authorized substitute service in the form of a first class mailing to the firm’s business address in Houston.
Zavaletta and other taxpayers filed suit against Dannenbaum in August.
They claim that it failed to abide by its Valentine Day’s agreement with BND to complete engineering work relating to the more than $15 million the firm got to engineer and manage the bridge project, which did not materialize.
Zavaletta contended that the firm’s registered agent James Dannenbaum was evading service of the lawsuit by refusing to accept the citation and process.
Euresti’s corresponding order was filed in the district clerk’s office Monday.
