Court order prohibits doctor from practicing at Sunshine Pediatrics
The Thirteenth Court of Appeals Friday reinstated Cameron County Court-at-Law No. 2 Judge Laura L. Betancourt's order prohibiting pediatrician Dr. Raul Ernesto Loaisiga from practicing at Sunshine Pediatrics.
The appellate court's reversal also lets stand Betancourt's further order dissolving the partnership between Loaisiga and Dr. Tania Jalil and her husband, Syed Jalil, effective Feb 28.
The appellate court also admonished Loaisiga, noting that the petition that he filed Thursday - through his attorneys Weldon Nixon and Mark Walker - that initially stayed Betancourt's orders, allowing Loaisiga to return to Sunshine Pediatrics, had been "misleading."
Walker had maintained that Betancourt prematurely ordered the dissolution and had not allowed for adequate notice to patients.
On Saturday, Walker accused Michael R. Cowen, the attorney representing the Jalils, of "misrepresenting" facts presented to the appellate court.
Cowen, who prepared an emergency motion of his own and secured the reversal, last week expressed confidence of a reversal "when the court reads the whole truth."
Central to the dispute is Jalil and her husband's attempts to dissolve their partnership with Loaisiga.
Jalil accused Loaisiga of "improperly touching patients" in a civil lawsuit filed in Betancourt's court in December. The lawsuit is still pending.
Loaisiga countered that the Jalils gained control of the partnership through deceit and that Jalil is making defamatory remarks to destroy his business.
