Man accused of raping 5-year-old daily
DONNA - A 28-year-old man faces criminal charges in connection with allegations that he sexually abused a 5-year-old relative.
According to a police affidavit, the young girl said Faustino Lozano Jr. raped her vaginally and anally whenever she visited her aunt's house, apparently on a daily basis.
After each sexual assault, the man would clean the girl using baby wipes, the record states.
The Brownsville Herald is not disclosing the child's relationship with the man, because it is the newspaper's policy not to identify those who may be victims of sex crimes.
An officer arrested Lozano on Saturday after the child's mother accused him of molesting the girl.
Lozano told the officer the victim would get on top of him while he was in his boxers and that once she was on top "she would move her body," the police affidavit states.
Two days after Lozano's arrest, the child was taken to Estrella's House, a child advocacy center in Edinburg, according to the affidavit. There, she told forensic interviewers that the man had penetrated her sexual organ and her anus.
The child's aunt told police the girl's mother had a case with the state's Child Protective Services Division because the child had contracted a sexually transmitted disease, the police affidavit states
When the aunt asked the child why the man cleaned her with baby wipes after molesting her, the girl said he was cleaning his "pee" off her, according to the affidavit.
Lozano was arraigned earlier this week in the Donna Municipal Court on charges of aggravated sexual assault of a child and continuous sexual abuse of a child. Each charge is a first-degree felony punishable by up to life in prison and a possible fine of up to $10,000 upon conviction.
The man is not listed in the Texas Department of Public Safety's public sex offender registry; however, Lozano has previously been convicted on misdemeanor charges of theft and driving while intoxicated, public records show.
He was also convicted of possession of marijuana and possession of a controlled substance in a drug-free zone.
Lozano was being held Wednesday at the Hidalgo County Jail in lieu of a $1 million bond.
